Virginia county rules
Spotsylvania County, VA vacation rental rules and taxes
Spotsylvania County had not adopted a short-term rental ordinance as of the latest update we found (January 2026), but it has been drafting one since 2024 that would add a permit, septic limits, and a posted fire exit plan. Stays pay 5.3% sales tax plus the county’s lodging tax, which Airbnb collects.
Checked against official sources November 7, 2026Lake Anna is split among Spotsylvania, Louisa, and Orange counties. Louisa County has had its own rules since 2024; check which county your home is in.

What to do
Watch for the county ordinance
The 2024 draft would have required a permit, capped guests at the septic system’s rating, required yearly septic pumping, a smoke detector in every bedroom, and a posted fire exit plan. A new draft is in the works. Ask county planning what’s pending before you buy.Source
Taxes on each stay
Stays under 90 days owe 5.3% sales tax, and stays under 30 days also owe the local transient occupancy tax. Airbnb collects both on its bookings. If guests pay you directly, file sales tax with Virginia Tax. For direct bookings, open a tax account with the Spotsylvania County Commissioner of the Revenue and ask for the lodging tax rate.Source
