Virginia county rules

Cumberland County, VA vacation rental rules and taxes

Since January 2024, Cumberland County requires short-term rental hosts to register with Planning & Zoning (no fee), hold a county business license, and pass a fire inspection every year. Rentals are allowed in the RA-1 district without a conditional use permit. Virginia Tax shows no county lodging tax, so stays pay 5.3% sales tax.

What to do

  1. Register and get a business license

Register the rental with Cumberland County Planning & Zoning (there’s no fee) and get a business license from the Commissioner of the Revenue. Ask Planning how districts other than RA-1 treat rentals.Source

  2. Schedule the fire inspection

Rentals need a fire inspection every year. Keep guests within the capacity your well or water system permit allows.Source

  3. Taxes on each stay

Stays under 90 days owe 5.3% sales tax, and stays under 30 days also owe the local transient occupancy tax. Airbnb collects both on its bookings. If guests pay you directly, file sales tax with Virginia Tax. Virginia Tax’s chart shows no Cumberland County transient occupancy tax.Source
